Florida Exam Prep Terms And Conditions
Updated October 12th 2026
PLEASE READ THESE TERMS BEFORE PURCHASING OR ENROLLING. DIGITAL ACCESS IS FOR ONE ENROLLED
STUDENT. SECTION 7 ADDRESSES FINAL SALES AND REFUNDS. SECTION 11 CONTAINS INDIVIDUAL ARBITRATION
AND A CLASS ACTION WAIVER, WITH EXCEPTIONS AND A 30-DAY OPT-OUT.
1. Agreement to these terms
These Terms and Conditions (“Terms”) are an agreement between Florida Exam Prep LLC (“Company,” “we,”
“us,” or “our”) and the purchaser or enrolled user who accepts them (“you”). They govern
https://floridaexamprep.com
, our courses, books, digital materials, recordings, practice questions, simulators,
software, student communities and related products and services (“Services”). By affirmatively accepting these
Terms at checkout, enrollment or another acceptance screen, you agree to be bound by them. You must be at
least 18 and legally able to contract.
Each enrolled student must accept these Terms before access, including when someone else pays. A person
purchasing for a business represents that the person has authority to bind that business. Unless we expressly
agree otherwise in writing, each enrollment covers one designated student. Our Privacy Policy at
https://floridaexamprep.com/privacy-policy
describes our information practices. Accepting these Terms does
not itself provide optional marketing-text consent. The limited promotional authorization for Student Success
Materials voluntarily submitted to us is described in Section 10.4.
2. Services and access
Our Services provide examination preparation only. We do not issue a contractor license or governmental
credential, determine eligibility, or guarantee a passing score, employment or income. Florida Exam Prep is an
independent provider and is not affiliated with or endorsed by the Florida Department of Business and
Professional Regulation (DBPR), the Construction Industry Licensing Board, any examination administrator or
developer, or any publisher. Our practice questions and simulators are instructional tools and are not
represented as actual examination questions. We do not guarantee that any particular question or topic will
appear on an examination. You are responsible for confirming current eligibility, approved book editions,
application deadlines, fees and examination-day rules.
Course access begins on the date of purchase and continues for 12 months. All courses have the same 12-
month access period. Access does not automatically continue until you pass or include future products,
unlimited support or perpetual availability unless we expressly provide that benefit in writing. If you complete
the entire purchased course, including every video, quiz and study guide, and do not pass the applicable exam,
our advertised tutoring guarantee provides one free one-hour tutoring session to review areas for
improvement. This benefit does not guarantee a passing result or itself create a refund right. Any additional
written guarantee presented with your purchase remains subject to its disclosed conditions and remedies.
Ownership of a purchased physical book does not include copyright ownership or a transferable digital
account.
3. Intellectual property and permitted use
3.1 Ownership. The Company and its licensors retain their rights in the original courses, books, manuals, videos,
audio, lessons, illustrations, practice questions, answer explanations, question banks, simulator software and
content, templates, compilations, instructional presentations, branding and other materials supplied through
the Services (“Materials”). These rights include protectable original expression and selection or arrangement.
Third-party materials belong to their respective owners. We do not claim copyright ownership of facts, public-
domain laws, general ideas or study methods as such.
3.2 Individual license. Subject to payment and compliance with these Terms, the designated student receives a
limited, nonexclusive, nontransferable and nonsublicensable license to access purchased digital Materials during
the purchased access period solely for that student’s own exam preparation. This includes preparation for the
student’s own professional work. It does not authorize teaching others from the Materials or using them to
supply a commercial product or service.
3.3 Authorized notes and downloads. You may make your own study notes and download or print only Materials
expressly designated for those functions, within the stated permissions. Authorized downloadable study guides
may be retained for your own study unless their disclosed license provides otherwise. Streaming content may
not be downloaded or recorded merely because a device makes that technically possible. Keep copyright notices
and watermarks intact. Ordinary temporary copies necessary for authorized browser viewing are permitted.
3.4 Confidential information. Nonpublic question banks, unreleased Materials and nonpublic instructional know-
how identified as confidential, or reasonably understood to be confidential from their restricted disclosure, may
be used only for your authorized preparation and may not be disclosed without our permission. This obligation
excludes information lawfully public, already lawfully known without restriction, independently developed
without using our confidential information, or lawfully obtained from an unrestricted source. It continues while
the information remains confidential; trade secrets remain protected while they qualify under law. Legally
compelled disclosure is permitted, with advance notice where lawful and disclosure limited to what is required.
4. Accurate information and lawful conduct
You must provide accurate enrollment, contact and payment information, use only payment methods you are
authorized to use, and comply with applicable law and these Terms. Do not impersonate another person,
misrepresent the enrolled student’s identity or submit false exam results. You are responsible for your conduct
and access you authorize or facilitate.
5. Accounts and login credentials
An account is for one designated student. You may not share, sell, rent, lend, transfer or pool an account,
password, authentication code, access link or licensed seat, including with family, coworkers or other students.
Do not allow another person to watch paid lessons through your account, take your quizzes, use your simulator
access or join a private group through your invitation. One employer-purchased seat does not permit multiple
employees to participate.
Keep your credentials secure and promptly report suspected unauthorized access to
[email protected]
.
We may require reasonable identity verification, reset credentials, limit concurrent sessions and investigate
unusual access using information described in our Privacy Policy. A change of device or location alone does not
establish account sharing. Do not evade authentication, access restrictions or a suspension.
6. Purchases and payment
Prices and applicable taxes, shipping and other charges are disclosed before purchase. Later price changes do
not alter accepted orders. Payment is due before access unless we expressly offer and agree to a payment plan
in writing. Payment plans are offered only at our discretion. A payment plan divides the purchase price; it is not
a cancel-anytime subscription unless expressly sold as one. Installment amounts and dates, and any automatic-
renewal and cancellation terms, must be disclosed and accepted as required by law. Unpaid amounts may result
in suspension of affected access.
Please contact us about billing concerns. Nothing requires you to contact us before exercising a lawful payment-
dispute right or penalizes a good-faith dispute. We may provide accurate purchase, acceptance and activity
records in response. Knowingly false fraud claims or intentional payment evasion may result in lawful collection
or other remedies. Fees and costs are recoverable only as authorized by law or an enforceable agreement,
without duplication.
6A. Text messaging
Providing a phone number or accepting these Terms does not itself authorize promotional texts. If you
separately opt in, Florida Exam Prep LLC may send the messages described in that opt-in, including service
notifications or promotional offers where authorized. Messages may use automated technology where
disclosed. Marketing consent is optional and is not a condition of purchase. You must be authorized to consent
for the supplied number and should notify us if it changes.
Message frequency varies; message and data rates may apply. Reply STOP to opt out or HELP for assistance, or
contact
[email protected]
or +1 443-695-6218. We honor other reasonable revocation methods required
by law and process requests promptly within applicable deadlines. A permitted nonpromotional confirmation
may follow an opt-out. Carriers are not liable for delayed or undelivered messages. Our Privacy Policy governs
messaging data. We do not share mobile opt-in information for independent third-party marketing.
7. Refund policy
ALL SALES ARE FINAL EXCEPT AS REQUIRED BY LAW OR EXPRESSLY PROVIDED IN THE WRITTEN OFFER
APPLICABLE TO YOUR PURCHASE. Review the included services, access period, technical requirements, book
editions and any guarantee before purchase. An unsuccessful exam result, change of plans or failure to use
available access does not alone create a refund right.
Nothing in this policy limits statutory rights, remedies for our failure to deliver purchased Services or benefits
under an applicable written guarantee. Promptly report damaged, incorrect or missing physical items by
emailing
[email protected]
with your order information and a description of the issue.
A full refund ends the license and access for the refunded digital Services, and you must stop using and delete
refunded digital Materials, subject to lawful evidence-preservation duties. For partial refunds or physical returns,
we will identify the affected access and return instructions. We will not condition a refund owed on a positive
review, removal of an honest review or waiver of a lawful payment dispute.
8. Software and support
Simulators and software are licensed for the purchased access period. You are responsible for compatible
equipment and reliable internet access consistent with disclosed technical requirements. Support and scheduled
instruction are limited to the purchased offer. Third-party platforms may have separate terms governing your
relationship with them; those terms do not expand your rights to our Materials.
9. Prohibited uses of the Materials
Except within Section 3’s permissions, with our express written authorization, or as permitted by law
notwithstanding these restrictions, you may not do or assist anyone else to do any of the following:
(a) Copy, scan, photograph, screen-capture, screen-record, audio-record, transcribe, download or systematically
extract Materials beyond the authorized personal-use permissions, including recording live instruction or
streaming lessons.
(b) Upload, publish, distribute, transmit, resell, license, publicly display or perform Materials, or provide copies
or digital access to unauthorized users. This includes sharing question banks, answer explanations, books or
recordings through social media, repositories, file-sharing services or outside study groups.
(c) Translate, adapt, paraphrase, repackage or otherwise use Materials or confidential information to create,
improve, supply or market a competing course, tutoring service, exam-prep program, book, question bank,
simulator, study product or similar commercial offering, including by supplying them to a competitor. This
restriction does not prohibit independent work using general knowledge or lawfully available sources.
(d) Upload or supply Materials or confidential information to external artificial-intelligence tools, model-training
systems, retrieval databases or automated content-generation services; use bots or scripts to scrape content; or
create an automated substitute for the Services. A tool or accommodation we expressly approve remains subject
to its authorized scope.
(e) Remove copyright notices or watermarks, bypass access or download controls, reverse-engineer protected
software except where law permits despite this restriction, access restricted systems without authorization,
distribute malware or disrupt security or availability.
(f) Request, post, transmit, describe, reconstruct, purchase, sell, obtain, share or assist in reproducing any actual
confidential licensing-examination question, answer choice, prompt, plan, diagram, selected answer or other
secure examination content, whether obtained from memory or by any other means. This includes examination-
specific numerical details and references identifying where the answer to a particular actual examination
question was located. Students may discuss publicly released examination outlines, approved reference
materials, general areas of difficulty and independently developed practice exercises.
Nothing in these Terms prohibits honest reviews, lawful complaints or payment disputes, reports to government
agencies, cooperation with investigations, communications with legal counsel, compliance with legal process or
other legally protected activity. Lawful disposition of an owned physical book remains permitted; it does not
authorize reproduction or transfer of digital access.
10. Student communities and student content
10.1 Participation. Company-operated groups, including WhatsApp groups, course chats and private student
communities, are for authorized participants and relevant study discussion. Harassment, threats, discriminatory
abuse, impersonation, spam, unauthorized advertising, commercial recruitment and repeated material
disruption are prohibited. Respectful questions, disagreement and honest criticism are permitted. Do not add
unauthorized participants, harvest contact details or redistribute private discussions or another person’s
information without permission, except for legally protected purposes. Course questions may be discussed
through designated channels; protected banks and lessons may not be reproduced in group posts.
10.2 Privacy. Group membership is restricted, but confidentiality cannot be guaranteed. Depending on the
platform, other members may see your name, profile, phone number and posts. Avoid sharing sensitive
identifiers or another person’s information. Report concerns to
[email protected]
.
10.3 Student submissions. You retain ownership of content you create and submit (“Student Content”). You
grant us a nonexclusive, royalty-free license to host, store, reproduce, format and display it as reasonably
necessary to operate its intended course or group, respond to you, moderate, maintain appropriate records and
comply with law. You must have the rights necessary for that use. A direct message is not licensed for group
display merely because you send it to us. However, Student Success Materials voluntarily submitted to us are
subject to Section 10.4. This license does not transfer ownership of your Student Content.
10.4 Student Success Materials and Promotional Use. If you voluntarily send Florida Exam Prep a testimonial,
comment, message, success story, exam pass notice, score report, pass paper, review, photograph, video, or
similar content concerning your experience with our Services (“Student Success Materials”), you expressly
authorize Florida Exam Prep to use, reproduce, display, publish, share, and promote those Student Success
Materials, together with your first name, on our Pass Board, website, social-media pages, and other marketing
or promotional materials, without further notice or compensation. You are not required to submit Student
Success Materials to receive course access or any other purchased benefit.
You represent that you have the right to provide the Student Success Materials and that they do not include
restricted examination content or another person’s personal information. Before submitting an exam-related
document, remove candidate numbers, birth dates, addresses, barcodes, and other unnecessary identifying
information.
You may request that Florida Exam Prep discontinue future promotional use of your Student Success Materials
by contacting
[email protected]
. That request will apply prospectively and will not require removal of
materials already printed, published, or scheduled for publication.
10.5 Recordings. Students may not record sessions without our written authorization and other required
permissions. Before we record participant audio, video or protected communications, we will provide notice and
obtain required consent. Instructional recording consent does not itself authorize identifiable promotional use.
11. Governing law and dispute resolution
YOU AND THE COMPANY AGREE TO BINDING INDIVIDUAL ARBITRATION OF COVERED DISPUTES INSTEAD OF A
COURT OR JURY TRIAL, SUBJECT TO THE EXCEPTIONS AND OPT-OUT BELOW.
11.1 Law and notice. Florida law governs these Terms, without conflict-of-laws rules; the Federal Arbitration Act
governs this arbitration agreement. Nonwaivable protections remain applicable. Before filing, either party
should provide a written description of the dispute and requested relief and allow 30 days for good-faith
resolution. Send Company notices to Section 19’s email or mailing address; we will use your account contact
information. This process does not prevent filings needed to preserve a claim, urgent relief, payment disputes
or agency complaints.
11.2 Arbitration. Disputes arising from these Terms, a purchase or the Services will be resolved by one neutral
arbitrator administered by the American Arbitration Association (“AAA”) under its applicable Consumer
Arbitration Rules and consumer due-process requirements, available at
https://www.adr.org/consumer
or from
us on request. Fees are allocated under those rules and law; the Company will pay amounts required of it,
including additional amounts required by law to avoid prohibitively expensive consumer arbitration. Hearings
may be remote or at a location reasonably convenient to the consumer under AAA rules. Written proceedings
may be used where appropriate. Selecting Florida law does not itself require travel to Florida.
The arbitrator may award individual relief available in court, including statutory remedies and attorneys’ fees
where authorized, and will issue a reasoned written award. Judgment may be entered in a competent court.
Each party otherwise bears its own attorneys’ fees. Courts decide formation and enforceability of this arbitration
agreement and class waiver; the arbitrator decides the merits of arbitrable disputes.
11.3 Exceptions and individual proceedings. Either party may pursue an eligible individual small-claims case in
an appropriate small-claims court or seek temporary court relief to prevent intellectual-property misuse or
unauthorized disclosure pending arbitration. Nonarbitrable claims and agency proceedings are excluded.
Covered claims must otherwise proceed individually, without class or representative proceedings or
consolidation of different persons’ claims without all affected parties’ written agreement, to the extent lawful.
A claim or remedy for which this waiver is unenforceable proceeds in court; remaining claims stay in arbitration
to the extent permitted by law.
11.4 Opt-out. Within 30 days after first accepting this version of the Terms, you may opt out by emailing or
mailing Section 19’s contact with your name, account email and a clear statement rejecting arbitration. This does
not affect your purchase or access. If you opt out, neither party is bound by this arbitration agreement or its
class waiver for disputes governed by these Terms.
11.5 Court and administration. For permitted court proceedings, the parties consent to courts with appropriate
jurisdiction in Orange County, Florida, or the federal Middle District of Florida, Orlando Division, except where
mandatory law or the small-claims exception permits another forum. If AAA declines because the Company has
not met its consumer requirements, you may elect court. If AAA is otherwise unavailable, the parties may agree
on a comparable provider; otherwise either may proceed in court. Changes to this Section require affirmative
acceptance and do not apply to an already-known dispute.
12. Indemnification
To the extent lawful, you will indemnify the Company and its personnel against third-party claims, damages and
reasonable defense costs caused by your unlawful conduct, material breach of the account or content-use
restrictions, or infringement of another person’s rights through your submissions. This excludes losses caused
by the Company’s negligence, willful misconduct or violation of law. We will provide reasonably prompt notice
and cooperation and permit a defense by competent counsel, with our right to participate at our expense. A
settlement may not admit our fault, impose nonmonetary obligations or omit a full release without our written
consent, not unreasonably withheld.
13. Suspension termination and enforcement
We may promptly suspend affected access while reasonably investigating suspected sharing, content misuse,
security threats, nonpayment or material misconduct, and terminate affected access for a substantiated
material violation. We may remove unlawful or infringing content and act without advance warning when
necessary to protect people, systems or rights. Where reasonably practicable, we will explain the basis and
provide a contact for review without disclosing sensitive security or third-party information.
A substantiated material violation may result in loss of remaining affected access without a discretionary refund,
subject to law, applicable guarantees and remedies for our own breach. Upon termination, cease affected access
and unauthorized use. On reasonable written request, remove unauthorized copies within your control and
confirm compliance, subject to legal preservation duties. Lawfully owned physical books need not be destroyed.
We may preserve evidence, submit good-faith infringement notices and seek available damages, costs and
injunctive relief. Relief remains subject to applicable legal requirements; no automatic penalty or injunction is
created. Ownership, continuing confidentiality, accrued payment obligations, dispute resolution, liability
provisions and other obligations intended to survive remain effective to that extent.
14. Disclaimers and limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXCEPT FOR EXPRESS WRITTEN PURCHASE COMMITMENTS,
SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT IMPLIED WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT. WE DO NOT WARRANT ERROR-FREE OR
UNINTERRUPTED OPERATION OR A PARTICULAR EXAM RESULT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY IS NOT LIABLE FOR INDIRECT, INCIDENTAL,
SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR OPPORTUNITIES. OUR TOTAL
AGGREGATE LIABILITY ARISING FROM A PURCHASE OR RELATED SERVICES WILL NOT EXCEED THE TOTAL
AMOUNT YOU PAID FOR THE PURCHASE GIVING RISE TO THE CLAIM.
These provisions do not eliminate express warranties, refunds owed or mandatory remedies, or limit liability for
our fraud, willful misconduct, gross negligence, personal injury caused by our negligence, or liability that law
prohibits us from limiting.
15. Force majeure
Neither party is responsible for delay in nonmonetary performance caused by events beyond reasonable control,
including natural disasters, government restrictions or widespread infrastructure failures, provided reasonable
mitigation and resumption efforts are made. Accrued obligations and mandatory remedies remain enforceable.
Extended unavailability of purchased Services is addressed in Section 17.
16. Privacy
Our Privacy Policy describes our handling of personal information and your choices. The promotional
authorization for Student Success Materials is governed by Section 10.4. Separate messaging consents govern
their respective uses. These Terms do not override nonwaivable privacy rights.
17. Changes to Services and terms
We may update Materials, maintain systems and change nonessential features. If we materially reduce promised
paid access or core content without your material breach, we will provide a reasonably equivalent replacement,
a suitable extension or an appropriate refund for the undelivered portion, including any fuller remedy required
by law. We will take reasonable steps to restore interrupted Services.
Updated Terms apply to future purchases and enrollments upon acceptance. Material changes to existing
contractual obligations require notice and affirmative acceptance. They do not retroactively change accrued
claims or expand earlier promotional permissions. Declining new terms does not itself forfeit previously
purchased rights; the previously accepted terms continue for that purchase unless otherwise agreed or required
by law.
18. General provisions
These Terms and the accepted written purchase offer and any separate payment or promotional agreement
govern their respective subjects. A specific purchase commitment controls over a conflicting general term; a
separate promotional permission controls its scope. Nonwaivable law controls. Failure to enforce is not a waiver.
An unenforceable provision is severed only as necessary, subject to Section 11.
You may not transfer a digital license or account without our written consent. We may assign this agreement
with the relevant business or assets subject to existing obligations, privacy commitments and law. No
employment, agency or partnership is created. You agree to electronic contracting and ordinary account notices
where lawful and may save or print these Terms or request a copy. Any separately required electronic-delivery
consent or notice method remains required.
